Ciolek files wrongful termination suit against City on behalf of Brian Schwartz

TOLEDO, OHIO – Tuesday, October 6, 2009, Brian Schwartz, former advisor to the Toledo’s Mayor Finkbeiner, has filed a lawsuit in Lucas County Common Pleas Court for wrongful termination. Mr. Schwartz’s attorney, Scott Ciolek, filed the Complaint this morning asking for a damage award in excess of $150,000.
The Complaint alleges that the City of Toledo had violated the State of Ohio’s prohibition on residency requirements (ORC § 9.481) when it demanded that Mr. Schwartz place is family’s home on the market or be terminated. Mr. Schwartz was out of work for more than a year.

October 6th, 2009 at 2:24 pmYes, Robin I agree with your question because at that time he should KNOW the conditions of his job which the lawsuit could be called for dismissal.
I noticed in the e-mail release that it mentioned Brian was a former advisor, don’t you need to have the background to “know” the ins & outs of public administration in order to be advising the mayor??? I thought he was a spokesperson who is responsible for public relations and write media/press releases.
I firmly believe he’s suing the City of Toledo because he was not able to land a full-time gig since he was fired, so he’s seizing the opportunity to do this. This case will be thrown out of court faster than they threw out the failed “Take Back Toledo” mayor-recall petitions.
The bottom line is, Brian needs to sue Carty Finkbeiner not the City of Toledo.

October 6th, 2009 at 3:08 pmBrian wasn’t fired, he quit. This is not the first lawsuit that was filed over Toledo’s residency rules and it probably will not be the last one. Those who were fired or forced to resign have that as an option since the Court ruled that Toledo can not demand employees reside in the City.

October 6th, 2009 at 8:03 pmSeems a little late, like he woke up one morning and said gee, I’m running out of money and have no job, I better sue somebody. Isn’t Ciolek one of the stain’s attorneys who will take any case? I thought Schwartz and Stainbrook broke up.
