I saw this last night on FOX Toledo but was working on something else last night so this my first chance to post this. It seems there is some mystery substance leaking from the site of the proposed Toledo casino site that the Ohio EPA is looking into. What’s interesting despite the subtitle of the post on FOX Toledo, Substance a potential snag for Toledo casino? it’s probably not a snag at all since the Ohio EPA signed off on the site.
The video story on the FOX Toledo website has updated information from the 4:00 p.m. coverage, where it’s stated the Ohio EPA has a covenant to not sue, the general definition of that according to the Ohio EPA:
This covenant releases the company from liability as part of Ohio EPA’s Voluntary Action Program (VAP). The program recognizes property owners for taking the initiative to evaluate and clean up any on-site contamination. It’s an opportunity to assess and, if necessary, remove pollution from a site voluntarily and encourage redevelopment. The covenant serves as a stamp of approval for work completed.
This is one of the concerns whenever a brownfield is involved, and I do find it interesting from an elections standpoint that the site for the Toledo casino is included on the ballot when there have been no community meetings, legislative approval or planning commission approval that involved any public commentary, at least not that I was aware of. While they don’t yet know what is leaking, I can safely guess it’s not “black gold…Texas tea.”
