Breaking News: Jan Scotland will not be on November ballot

Story in from a variety of sources, will update with links as soon as they are online that the Republican party had until 4pm to file paperwork to make Scotland official, but according to Pat Kriner a letter was faxed after 4:00 p.m. and is therefore invalid…

Fox Toledo broke the story, it’s on their website on the breaking news bar.

    From the aboveforementioned story from FOX Toledo:

    The Republican party had until 4pm to file paperwork to make Scotland official, but according to Kriner a letter was faxed after 4pm. The board consulted attorneys, but Kriner says a state statute demands that 4 pm be the deadline, and that deadline was missed.

    Who’s responsibility was this?

    It appears it was the responsibility of the Lucas County Republican Party when you read the ORC Section 3513.31:

    (D) If a person nominated in a primary election as a party candidate for election at the next general election, whose candidacy is to be submitted to the electors of a district within a county, withdraws as that candidate or is disqualified as that candidate under section 3513.052 of the Revised Code, the vacancy in the party nomination so created may be filled by a district committee consisting of those members of the county central committee or, if so authorized, those members of the county executive committee in that county of the major political party that made the nomination at the primary election who represent the precincts or the wards and townships within the district, if the committee’s chairperson and secretary certify the name of the person selected to fill the vacancy by the time specified in this division, at a meeting called for that purpose. The district committee meeting shall be called by the chairperson of the county central committee or executive committee, as appropriate, who shall give each member of the district committee at least two days’ notice of the time, place, and purpose of the meeting. If a majority of the members of the district committee are present at the district committee meeting, a majority of those present may select a person to fill the vacancy. The chairperson and secretary of the district committee meeting shall certify in writing and under oath to the board of the county, not later than four p.m. of the seventy-sixth day before the day of the general election, the name of the person selected to fill the vacancy. The certification must be accompanied by the written acceptance of the nomination by the person whose name is certified. A vacancy that may be filled by an intermediate or minor political party shall be filled in accordance with the party’s rules by authorized officials of the party. Certification must be made as in the manner provided for a major political party.

    According to the Secretary of States election calendar that date is today:

    Aug. 20 – A political party or independent candidate’s nominating committee must certify the name of a person to fill a vacancy caused by the withdrawal of a candidate by 4 p.m.

    This is a huge mistake for the GOP. I don’t know if this ever occurred before. Wasn’t it Jon who criticized the GOP for handing notice of the central committee in late? You would think he would be punctual on something such as this. Where are these scores of volunteers? You would think they would hand it in with plenty of time to spare. Jon should apologize or resign over this.

    Everyone knows that this is due to the Wack-Olman-Kriner love triangle. Joanne Wack stole silver in 1989, thus preventing an honest, hard-working citizen like Jan Scotland from getting on the ballot. I once saw Chris Myers talking to Joanne Wack. In summary, Tom Noe smells.

    Pat Kriner will be on with Thursday (tomorrow) at 6:10a. I spoke with Linda Howe this evening, and Matt Bartow who sent the fax in question. And there is a very interesting side bar about Mr. Bartow and Mr. Stainbrook and where they were at 6:22p this evening. No suprise that Stainbrook isn’t returning calls.

    FOX Toledo News spoke to Lucas County Republican Party Chair Jon Stainbrook, and he says he had been told by the Board weeks ago that all of Scotland’s paperwork was in, and nothing else was needed. They plan to say more about this in the near future.

    Chris, yes it appears to be another drama adventure, if that is true, considering they’ve made it a point to say they don’t trust the current BOE, if I were them, I wouldn’t take their word for anything. It took all of two minutes to look up the requirements in the ORC and I’m not a lawyer.

    Nor does that explain why if they thought everything was in they would try to fax it today after 4:00 p.m.

    Technically Ross’s comment should be deleted since he did not include a valid email – however, by IP address looking at past comments? I concluded it was meant as sarcasm/satire. Since you commented deleting the comment would probably create more questions than leaving it – hence the reminder to Ross to make sure he uses a valid email or I’ll have to delete future comments.

    Tina, election law can be confusing which is why some of us (myself included) learned the hard way to check the calendar that the SOS provides and to at least have a basic knowledge of the requirements set out in the ORC. Or to contact the Secretary of State’s office if there is a question.

    It appears in this scenario what was required was needed from the Party though time will tell who was responsible. Jan Scotland could have checked with the BOE or the SOS.

    Can’t say I have a whole lot of confidence in the Lucas Co BOE. It took two mailed in requests as well as three follow up phone calls to assure that I will be able to vote using my new address…After a mess like this on behalf of a candidate by the BOE, glad I did my follow up when I did! Sheesh…what a mess.

    It also looks like Rogue that the chairman of a party should develop better lines of communication, if it’s the responsibility of the chairman of the BOE to notify candidates that they didn’t meet a deadline.

    The spin on this trying to turn it to blame on the BOE is going to be interesting, at least we know where the Blade will head with it. When mine was messed up? It was my fault, I’m the person responsible for making sure things are done properly…

    Mindy, the deadline for voter registration is October 6th, depending on when you filed your address change it does take time to show up in the system. I do advise that anyone, no matter which county they live in take the time to check prior to October 6th if they have moved. Or to check online, the information is on the Secretary of State’s website.

    Having been in this situation myself, the sole responsiblity for filing the paperwork lies with the local party. The form should have been signed the night Scotland was endorsed and filed with the BOE the very next morning.

    The republican board workers are NOT – in any way – responsible for the party filing the proper paperwork. I predicted, on my blog, that this will somehow be spun to be the fault of Kriner and Olman etc…

    But I cannot say it any plainer – it’s not the role of the BOE to make sure the local parties or any candidates file their forms on time. They don’t go out and make sure that all the people who file signatures get them in before the deadline – so why should this filing of a vacancy be any different? It’s not!

    Major screw-up by the party. True test of leadership will be how it’s handled….

    You are so right, dilligence pays off! But I have to wonder just how long it takes to process a change of address submitted at a ‘non-critical’ time. I guess I’d understand the time it took ( first week of July submitted – last week confirmed) if it was closer to that October deadline. Oh well, I suppose there are just some things mere mortals wern’t meant to understand!

    Mindy we learned that the hard way, we assumed one of my daughters was registered to vote, and discovered too late that it did not appear the form was turned in. Everything in life ends up being a lesson, similar to Maggie’s thoughts, it’s the true test of each of us if we accept responsibility for what part was within our control or not…

    July isn’t exactly a non-critical period for the Board of Elections; they had the Anthony Wayne special election to put on, as well as dealing with state-wide petitions (verifying 30,000 signatures) and several candidates have been out doing voter registration drives.

    This situation with Scotland is truly unfortunate; he’s been out working hard, going door-to-door, press conferences, etc., and now it is all for nothing.

    Anytime you file a campaign-related document with the board of elections, you get a receipt; personally I usually take a copy of what I am filing and get it time/date stamped for my records. If Stainbrook filed something that he thought put Scotland on the ballot, he should have receipt. No receipt … no proof that anything was filed. Any one who has dealt with the BoE and getting candidates on the ballot should know simple verbal or telephone communications are not enough to get anything or anyone on the ballot.

    You are not serious about this! You are actually going to try and dredge up Joanne Wack again over the utter incompetence of Jon Stainbrook and Matt Bartow! Seriously get a life! Joanne Wack is gone and no longer has a say in anything. Bringing her up again at a time like this is truly the last defense of a witless person.

    This screw up rests solely on Jon Stainbrook’s poor leadership and by proxy his criminal henchman like Matt Bartow.     The BOE is not allowed to show favoritism to any party or candidate, calling in a friendly reminder to the GOP would have violated those rules. Do you think they had to call Scotland’s opponent and remind her to file her paperwork? Is the BOE now the secretary for Stainbrook?
    If the BOE would have called him to remind him of this important date he would have screamed foul just to make them look bad anyhow.

    One has to wonder if he did this on purpose just to get his name in the paper again.

    Duh – I spoke to both the Toledo police and Sylvania Township police, and quite honestly both passed the buck (where did the crime, ‘if’ there was one, occur?), leaving me with little option. Judge Christiansen did file charges, there was some sort of settlement and restitution. One would think that would have been enough for everyone within the party to cut ties with Bartow, but apparently not.

    Duh – Bartow was later charged with a crime by Judge Christiansen and forced to admit the crime in open court to avoid a felony conviction. That by itself should have been enough to keep both Bartow and Jon away, but it wasn’t.

    The fact is the Party should have kept people like Jon Stainbrook and that criminal Bartow away from the Party, but many members of the Central Committee didn’t bother to show up the day of the vote to keep Jon and his criminal henchmen from winning. Unfortunately this is what you end up with when you have an apathetic Central Committee.

    However I am going to make a forecast right now. The Bland newspaper will do a story on this, but since Jon is their boy they will write a piece that clouds the issue and slants it in Jon’s favor, i.e. the BOE “mislead” him or told him something that wasn’t true. Follow that up with a few quotes from Jon where he says this is why he wanted to replace BOE members to stop this type of abuse and blah blah. The end result is nobody will put the pressure on Jon to step down which is the only decent thing he can do at this point.

    On a positive note, without any Republican candidates on the ballot Jon and Bartow won’t have anyone to steal from this year, which will really put a crimp on he and Bartow’s earning potential for the election season.

Bartow is currently or has been in a felony diversion program for STEALING from Lucas County Republican candidates just a few years ago.     Nick, perhaps you missed the part where it’s been stated that it wasn’t the responsibility of the BOE to tell the party chairman what he needed to do. The ORC and a former elected official who actually went through the process make that fairly clear.

    There are procedures and rules and they are easily available. Jon and his friends are very knowledgeable when it comes to how to search the Ohio Revised code, especially when it comes to election issues. They also have access to the Secretary of State’s calendar which clearly lists the exact section of the ORC that it references.

    I’d have to agree that the whole Wack story line has surpassed the beating the dead horse stage. As has been pointed out more than once, and more than twice, there is a selectivity issue here. If it is wrong to have people with records in the party, then it should be the same standard for all.

    Considering the past research that was done on the records of those currently in leadership positions, it’s impossible for anyone to argue with a straight face that Wack’s record matters in comparison.

    Nor does it really have any bearing on what happened but the Blade and Jon have made her famous. Too bad she can’t earn royalties on each time her name is mentioned…

    How unfortunate this is for all of us. Once again Toledo politics succumbs to a one party system. Republicans as a whole will come across as ineffectual and perhaps, inconsequential with regards to local politics.

    Okay, I just put away the bottle of Jack Daniels and a half a pack of cigarettes and my nerves are calming a bit. I am starting to see things rationally. If Jon Stainbrook and his associates did what they should have done, they would have kept a record of it. Any idiot who can figure out a fax machine knows that when you send time sensitive documents, you can set just about any fax machine made this decade to print you a “transaction record” of said fax, which will clearly show how many pages you sent to what phone number at a particular time, and that they were sent successfully. If they can’t produce this, then they’ve got some explaining to do, Lucy.

    Lisa, the only way the Blade would push for any Republican – black, white or what have you – would be if they crawled on their belly all the way to Pittsburgh and kissed JBR’s crusty, old, wrinkly posterior. And if Mr. Scotland did such a thing, I say good riddance to bad rubbish.

I’m no card carrying Republican, just an ordinary everyday citizen that pays his bills, paid for his education, served his country, and made the colossal mistake of buying a home here, and is tired of the crap that gets force fed down his throat.     Here’s the deal:
    Stainbrook who is this self described “politically experienced operator” with years and years of political involvement should know that it requires something to be filed (ie. Petitions) along the lines that most standard candidates have to do. You just don’t expect the BOE to read the paper and see what candidates have announced and put them on the ballot do you?

    Bartow who is actively working alongside Stain has the experience dealing with these issues to have known better.

    Scotland should have known that it requires more than just filing a designation of treasurer form. That form and filing candidacy paperwork are two wholly different things. He does have that experience as a former elected official and candidate. I suspect that he asked the question along the lines of “Is this form all I need to set up a campaign finance account?”. He probably wasn’t referring to getting on the ballot. And if he was he didn’t make himself clear or back to the original thought, he should have known better from his past experience.

    The difficult part of the lawsuit would be finding someone brave enough to file it. Don’t think the blade won’t go digging into their background to find every unpaid parking ticket or classmate from kindergarten who would be willing to go on the record saying he stole their crayons.     Stainbrook is too stupid to realize he was used as a pawn by JRB and the Blade. In 2004 Lucas County turned out 40% for George Bush. This was coincidentally the same election that Jon Stainbrook was working for John Kerry’s campaign… being the good Republican that he is.

    I digress, the Blade and many national and I am sure local Democrats caught a lot s*it for not crushing this effort and making sure Lucas County turned out well under 40% for Bush.

    Making sure he would not be outdone in 2008 JRB used Stainbrook as a pawn by writing tons of free puff pieces to insure public opinion would go his way and get him in the chair position. He knew if he could get Jon in there that Jon would deliver award winning incompetence and insure that Lucas county would never come close to turning out 40% for McCain this November.

    Need more proof? How about the puff pieces that the City Paper wrote. That liberal rag has never said a nice thing about a single Republican in its entire pathetic history… until Stainbrook came along. Does anyone honestly believe that the City Paper cared about a strong and revived LCRP? If you do you are living in a world of fantasy. Their purpose was the same as JRB, put an incompetent idiot like Stainbrook in there and watch the fallout.

    I say any resident of Lucas County that wanted to cast a vote for Mr. Scotland should claim they are disenfranchised and we want our voice heard. I am contacting the Secretary of State’s office. We have no choice in our county leaders. They are now appointed. Stainbrook needs to resign right now. His lack of effective leadership in dropping this ball is reason enough for his stepping down.
