Noe Sentencing…18 years plus federal sentence

The Prosecution wanted 20 years…the Defense wanted 10 which we now discover was offered as an earlier plea agreement.

Seems like the main focus at this point watching live is should this sentence run with the federal sentence or be separate and will this sentence be similar to what others have received who have been accused/convicted of charges involving more money.

Well, his legal representation had advised Noe not to make a statement…

Now Judge Osowik is going thru the charges, he said it was a run of mill embezzlement case. Judge Osowik then continues that this case had a great deal of pre-meditation. He finds the shortest prison term would demean the seriousness of the offense. The judge seems to appear to believe that the case the Prosecution provided as a comparison that gave 18 years was more comparable than the one the Defense provided as a comparison.

The fact that Noe was advised to not speak made the Judge say Noe showed no remorse.

10 years, 8 years, consecutive, 4 years consectuve yet concurrent, 4 years concurrent but consecutive, 11 months concurrent yet consecutive, 6 months concurrent yet consecutive a fine of 20,000 – fine of 10,000 – fine of 20,000 – fine of 10,000 on each count – 1,000 for each 8 counts, 2,500 on each one – restitution – hearing one week from today. It also appears that the house in Florida might also be taken. The total ends up being over 20 years, 18 years state then the federal.

The sentence will be served separate from the federal sentence.
